Introduction of Competition 比賽簡介

調解(Mediation)是其中一種另類排解糾紛的方式。這種解決爭議的方式近年在法律界越發受歡迎，主要是因為對比傳統法庭訴訟而言，其成本效益較高以及能避免破壞雙方關係。香港在2009年進行民事司法改革後，調解更成為法庭訴訟程序的一部份。在某些類型的案件當中，與訟雙方必須先嘗試進行調解，在調解失敗後方可繼續進行法庭程序。

Mediation is a form of alternative dispute resolution mechanism that is gaining prominence within the legal field for its cost-effectiveness and the added benefit of preserving parties’ relationships compared to traditional litigation. Following the reforms on the Hong Kong civil justice system in 2009, mediation is now a part of the litigation process, compulsorily requiring parties in specified categories of cases to attempt mediation before proceeding on litigation.

Competition Mode 比賽形式

競賽第一日，大會將安排參賽者參與由資深調解員主講的互動課堂。講者將於課堂內介紹調解的基本理論及技巧。大會亦會安排資深調解員進行調解示範，讓同學透過觀察和模仿學習調解技巧。

競賽第二日，各參賽隊伍將參與兩(2)場模擬調解，並充當調解員的角色。在每場模擬調解當中，各參賽隊伍將被給予一個商業 / 學校 / 家庭的模擬場景，參賽者須用課堂內所學的各種技巧調停調解雙方之間的矛盾。調解雙方將由本會成員及香港樹仁大學的同學扮演。

Interactive lessons will be conducted by experienced practitioner(s) during which basic theories and techniques of mediation will be introduced. A mediation demonstration will be conducted by experienced mediators, during which students would be able to learn mediation skills through observation and imitation.

For the second date of the tournament, each team would participate in two (2) mock mediation sessions as “mediator”. In each mock session, the teams would be given a commercial / school / family scenario where they have to utilise the skills learnt in the Interactive Lessons in reconciling the conflict between the mediating parties, which will be played by members of the Association / students of the Hong Kong Shue Yan University.

日期：互動課堂及示範環節 – 2023 年 3 月 4 日(星期六)；模擬調解環節 – 2023 年 3 月 5 日(星期日)
時間：早上9時至下午5時 (To-be-confirmed)
地點：香港樹仁大學 (實體進行)
對象：中一至中六（包括本屆文憑試考生）
名額：12隊伍（每隊3-4人）
費用：費用全免（報名費用全免。每隊需以支票形式支付HK$ 500 訂金。如參賽隊伍參與並完成競賽中的所有環節,本會將退回付款支票。）
報名截止日期：2023年2月24日 (星期五)

Date: Interactive Lessons and Demonstrations – 4 March 2023 (Saturday); Mock Mediation Session – 5 March 2023 (Sunday)

Time: 9am to 5pm (To-be-confirmed)

Venue: Hong Kong Shue Yan University (face-to-face lesson)

Target: Students from F.1 to F.6

Quota: 12 teams (3-4 students per team)

Fee: FREE (subject to a deposit of HK$500 pay by cheque – if the teams took part in all sessions of the competition, the Association would return the cheque)

Deadline for Application: 24 February 2023 (Friday)

Application Method 報名方法

(1) 填寫報名表

有意參加者須先填妥並遞交網上報名表: https://forms.gle/zdPfDLpkZ6odNBn56;

(2) 等候通知成功參加

在收到填妥之Google問卷後，本會將以電郵通知已成功登記之參加者;

(3) 寄出支票及回郵信封

獲通知成功登記之參加者須: –

於本會通知電郵發出後的七個工作天內(或經溝通後本會同意的其他時間);
將港幣 500元的支票郵寄至「摩理臣山郵政局郵政信箱47111號」;
支票抬頭為「HONG KONG SCHOOLS MOOTING AND MOCK TRIAL ASSOCIATION」;
支票背面亦請清晰寫明參加隊伍/參加學校之中文及英文名稱。

為方便本會寄回訂金支票，參加者須在郵寄支票時，同時向本會郵寄一個附上貼有足夠郵費的郵票及清楚寫上地址的回郵信封。

(4) 上載支票副本

參加者請於寄出支票時將該支票之影印本/副本上載至另一Google 問卷（連結將於通知成功參加的電郵中提供）。本會收到支票副本的時間將被視為支票寄出之時間。

(5) 等候通知成功付費

在收到參加者的支票時，本會將以電郵回覆確認已收取支票。

**註: 費用只作訂金之用。如參賽隊伍參與並完成競賽中的所有環節，本會將退回訂金支票。

(1) Complete the Application Form

(2) Pending Notification of Successful Enrolment

Upon receipt of the completed application Google form, the Association will send a confirmation email to notify the teams who have successfully registered in the Tournament;

(3) Mailing of Cheque and Return Envelope

Notified Teams shall: –

within 7 working days after the Association sent the notification email (or other agreed time);
mail a HKD $500 cheque to “Morrison Hill Post Office PO Box 47111“.
The cheque should be made payable to “HONG KONG SCHOOLS MOOTING AND MOCK TRIAL ASSOCIATION”;
Please clearly indicate the Chinese and English name of the participating team / school on the back of the cheque.

To facilitate the returning of the deposit cheque, participants are required to send along a blank envelope clearly indicating sender’s address with a stamp of sufficient postage.

(4) Uploading the Soft Copy of the Cheque

When mailing the cheque to the Association, participants should also upload a copy of the cheque to another Google form (link to be provided in the confirmation email). The Association will deem the time of receipt of the copy of the cheque as the time the cheque was mailed.

(5) Pending Notification of Successful Payment

The Association will confirm by Email when the cheque is received.

**Note: The fee shall be treated as deposit only. If the participating teams attend and complete all sessions of the Tournament, the deposit cheque will be returned.
